Terms of Use

These terms govern your use of OMARIVA, operated by トップファンド株式会社 (TOPFUND), Japan (“we”, “us”). They apply to the public website, enquiries for events and experiences, and the controlled My OMARIVA beta. Please read them together with our Privacy Policy.

1. What OMARIVA provides

OMARIVA shares information about active lifestyles, recovery and wellbeing, provides access to selected events and experiences, and may offer personalized educational insights through My OMARIVA. The features available at any time are those actually described on the site. An institution shown as a resource is not necessarily a formally appointed partner or guaranteed service provider.

2. AI and health information

AI-assisted content, assessments, reports and action suggestions are for education and personal reflection. They may be incomplete or incorrect and are not medical diagnosis, treatment, a prescription or emergency advice. Do not make urgent or significant health decisions solely on this content. For symptoms, injuries or medical concerns, consult an appropriately qualified professional; in emergencies, seek local emergency help.

3. Accounts and beta access

Some My OMARIVA features require an account or permission. The controlled beta may limit access, usage or available functions, and may change with appropriate notice. Please provide accurate information, keep your credentials secure and do not use another person's account without authorization.

4. Your entries and privacy

You remain responsible for information you submit and for having the right to submit it. Do not enter other people's private records without authorization, or upload detailed medical records through public enquiry forms. Your own text and records remain yours, subject to applicable rights; you permit OMARIVA to process them as reasonably necessary to provide the requested service, as explained in the Privacy Policy.

5. Invitations, introductions and experiences

Submitting Request an Invitation, Request Journey Details, Request an Experience or a similar form is an enquiry or expression of interest, not a confirmed reservation, membership approval or purchase. Arrangements, suitability, availability, pricing and any separate provider terms are confirmed individually. Where a service is provided by a clinic, practitioner or venue, its own applicable terms, professional explanation and consent processes may apply.

6. Acceptable use

You must not impersonate others, submit fraudulent applications, misuse personal information, interfere with the service, attempt unauthorized access, exploit security weaknesses, scrape or redistribute content without permission, or use the service unlawfully.

7. Intellectual property

OMARIVA's branding, text, design and software belong to their respective rights holders. Third-party names, logos, photographs and materials remain subject to their owners' rights. Access to the website does not grant permission to commercially reuse them.

8. Availability and responsibility

We may update or temporarily interrupt the service for maintenance, security or operational reasons. We do not guarantee uninterrupted access, perfect accuracy, particular health results or the availability of third-party experiences. Nothing in these terms excludes liability that cannot lawfully be excluded, including protections applicable under Japanese consumer law.

9. Payments and future paid services

Submitting an enquiry on the current site does not create an online payment obligation. Before introducing any paid membership, subscription, event or journey checkout, we will present the relevant price, taxes, billing period, renewal, cancellation, refund and service conditions separately. These future sales are not governed by an undisclosed or implied subscription agreement.

10. Updates, governing law and contact

We may update these terms with notice appropriate to the change and applicable law. Japanese law governs these terms, without limiting mandatory protections that may apply to users elsewhere.
